TERMS OF SERVICE

OVERVIEW

Welcome to House of TCGs ("HTG", "we", "us" or "our").

House of TCGs operates the House of TCGs online store, website, mobile application and the related information, content, features, tools, products and services made available through them, collectively referred to as the "Services".

Parts of our Services are powered by Shopify, which provides technology that enables us to operate our online store, customer accounts, checkout and related commerce functionality.

These Terms of Service, together with any policies referenced in them, govern your access to and use of the Services and purchases made through House of TCGs.

By accessing or using the Services, you agree to these Terms to the extent permitted by applicable law.

If you do not agree to these Terms, you should not use the Services.

Mandatory statutory consumer rights remain unaffected.

SECTION 1 – ACCESS AND CUSTOMER ACCOUNTS

You may browse parts of the Services without creating an account. Certain functionality may require a House of TCGs customer account.

When creating or using an account, you must provide accurate, current and complete information where requested.

You are responsible for maintaining the security of the email account, device and authentication methods used to access your House of TCGs account.

You must not:

  • Access another person's account without authorization

  • Transfer or sell your account

  • Provide deliberately false account information

  • Attempt to circumvent authentication or security measures

  • Use accounts to abuse promotions, purchase limits or HTG Loyalty

If you are not legally capable of entering into a binding contract on your own, you may only use purchasing functionality with the authorization of a parent or legal guardian where required by applicable law.

We may restrict or suspend access to an account where reasonably necessary to protect the Services, prevent fraud, comply with legal requirements or respond to material violations of these Terms.

Existing statutory rights relating to completed purchases remain unaffected.

SECTION 2 – PRODUCTS

House of TCGs primarily offers trading cards, sealed TCG products, collectibles and related merchandise.

We make reasonable efforts to ensure that product descriptions, images, pricing and other information displayed through the Services are accurate.

However, product packaging, artwork, colors and minor visual details may differ from images displayed on a screen or may be changed by manufacturers, publishers or distributors.

Product images may be used for illustrative purposes where clearly appropriate.

Availability is not guaranteed until an order has been accepted.

We may discontinue products or limit quantities available to individual customers where reasonably necessary, particularly for limited releases, high-demand products, product drops, fraud prevention or fair purchase limits.

Nothing in this section limits your statutory rights if goods do not conform to the contract.

SECTION 3 – ORDERS AND CONTRACT FORMATION

By submitting an order through the House of TCGs website or mobile application, you submit a binding offer to purchase the selected products.

Before submitting your order, you will have an opportunity to review relevant order information presented during checkout.

An automated confirmation that we have received your order does not necessarily mean that your order has been accepted unless the confirmation expressly states otherwise.

House of TCGs may accept your order by:

  • Sending an explicit order acceptance

  • Sending a shipping confirmation

  • Dispatching the goods

The contract is concluded when the first applicable acceptance event occurs.

We may decline or cancel an order before acceptance where there is a legitimate reason, including:

  • Product unavailability

  • An obvious pricing or product information error

  • Payment failure

  • Suspected fraud

  • Abuse of promotions or loyalty benefits

  • Circumvention of clearly communicated purchase limits

  • An inability to supply the ordered product

If payment has already been collected for an order that we do not accept or that must be cancelled, the applicable amount will be refunded.

Please review your order carefully before submitting it.

Your statutory cancellation and withdrawal rights remain unaffected.

SECTION 4 – PRICES AND PAYMENT

The price applicable to an order is the price displayed during checkout at the time the order is submitted, subject to the correction of obvious errors as permitted by law.

Applicable taxes, delivery charges and other mandatory costs will be displayed before the order is submitted where required.

Available payment methods are shown during checkout.

Payments may be processed by Shopify or independent payment providers.

By selecting a payment method, you confirm that you are authorized to use that payment method.

Additional terms of the selected payment provider may apply to the payment transaction.

Promotional prices, discounts and offers may be subject to separate conditions displayed with the relevant promotion.

SECTION 5 – SHIPPING AND DELIVERY

Available shipping methods, shipping costs and estimated delivery times are displayed through the Services where applicable.

Delivery times are estimates unless a binding delivery date has expressly been agreed.

Delays may occur due to circumstances outside our reasonable control, including delays involving carriers, suppliers, manufacturers, publishers or distributors.

For consumers, the risk of accidental loss or damage remains with House of TCGs until the goods are delivered to you or to a person designated by you, except where applicable law provides otherwise.

This section does not limit statutory rights relating to delayed delivery, non-delivery, damaged goods or defective goods.

SECTION 6 – PRE-ORDERS

House of TCGs may offer products for pre-order before their official release or before inventory has arrived at our warehouse or fulfillment location.

Dates shown for:

  • Product releases

  • Supplier deliveries

  • Warehouse arrivals

  • Shipping

  • Estimated delivery

may be based on information provided by manufacturers, publishers, distributors or other suppliers.

These dates may change.

Where a publisher, manufacturer or distributor changes a release or supply date, House of TCGs may update the estimated availability or shipping date accordingly.

A pre-order does not guarantee that an external manufacturer, publisher or distributor will maintain its originally announced release date.

If a pre-order product becomes unavailable or cannot reasonably be supplied, we may cancel the affected item or order and refund payments received for that item.

Any statutory rights you have in connection with delays, cancellation or withdrawal remain unaffected.

Product-specific pre-order conditions displayed before purchase may additionally apply.

SECTION 7 – RETURNS, WITHDRAWAL AND REFUNDS

Returns, withdrawals and refunds are governed by our Return & Refund Policy and applicable statutory consumer law.

House of TCGs may provide voluntary return rights in addition to statutory rights.

Any voluntary return policy does not restrict mandatory statutory rights.

Where you receive a damaged, defective, incomplete or incorrect product, please contact:

as soon as reasonably possible so we can review the issue.

Your statutory rights relating to defective or non-conforming goods remain unaffected.

SECTION 8 – HTG LOYALTY AND REWARDS

House of TCGs may operate an HTG Loyalty or rewards program through the website and mobile application.

Unless expressly stated otherwise:

  • Loyalty points are promotional benefits and are not cash

  • Loyalty points cannot be directly exchanged for cash

  • Points may only be redeemed using redemption methods made available by HTG

  • Rewards may be subject to availability

  • Certain promotions may provide additional points or rewards

  • Points connected to a refunded, cancelled, reversed or returned transaction may be reversed

  • Fraudulently or improperly obtained points may be removed

  • Attempts to manipulate the loyalty system may lead to proportionate account restrictions

Specific rewards, promotions or campaigns may be subject to additional conditions displayed when the offer is made.

We may make reasonable changes to HTG Loyalty for operational, economic, security or legal reasons.

Any changes will respect mandatory consumer rights and legally protected rights already acquired by customers.

SECTION 9 – PROMOTIONS AND DISCOUNT CODES

House of TCGs may offer promotions, discount codes, rewards, special releases or other promotional benefits.

Unless otherwise stated, promotions may:

  • Have an expiration date

  • Apply only to selected products

  • Apply only to selected customers

  • Require a minimum purchase amount

  • Have a maximum redemption limit

  • Be limited to one use per customer or account

  • Not be combinable with other promotions

Specific terms displayed with a promotion take precedence over this section for that promotion.

Promotional benefits obtained through fraud, manipulation or technical errors may be cancelled where legally permitted.

SECTION 10 – HOUSE OF TCGS MOBILE APPLICATION

These Terms also apply to the House of TCGs mobile application.

The mobile application may provide functionality including:

  • Browsing products

  • Purchasing products

  • Pre-orders

  • Customer account access

  • Wishlists

  • HTG Loyalty

  • Rewards

  • Order information

  • Notifications

  • Product drops

  • Other House of TCGs features

Features may be added, modified or removed as the application develops.

We may release updates, security fixes, performance improvements or new features.

Temporary interruptions may occur due to maintenance, updates, technical problems or third-party infrastructure.

Where you purchase physical products through the House of TCGs application, your purchase contract is with House of TCGs and not with the operator of the application marketplace through which you downloaded the app.

Separate terms imposed by Apple, Google or another application marketplace may also apply to your use of their respective platform.

SECTION 11 – INTELLECTUAL PROPERTY

The Services and original House of TCGs materials, including our branding, original graphics, text, application interface elements, website design and other original content, are owned by or licensed to House of TCGs unless otherwise stated.

Third-party trademarks, trading card brands, game names, logos, artwork, product images and other intellectual property remain the property of their respective owners.

The appearance of third-party products or trademarks through House of TCGs does not transfer ownership of those rights to HTG and does not imply an affiliation unless expressly stated.

You may not reproduce, distribute, commercially exploit or materially modify HTG-owned content without authorization except where permitted by law.

SECTION 12 – OPTIONAL THIRD-PARTY TOOLS

Parts of the Services may provide access to functionality supplied by third parties.

Such functionality may include payment processing, shipping, authentication, analytics or other supporting services.

Independent third-party services may be governed by their own terms and privacy policies.

House of TCGs is not responsible for independent third-party services to the extent those services are outside our reasonable control.

Nothing in this section limits liability that cannot legally be excluded.

SECTION 13 – THIRD-PARTY LINKS

The Services may contain links to websites, applications or other platforms operated by third parties.

If you leave the House of TCGs Services and interact with an independent third party, that third party's terms and privacy practices may apply.

We do not control independent third-party websites and are not responsible for their content, availability or practices unless applicable law provides otherwise.

SECTION 14 – RELATIONSHIP WITH SHOPIFY

House of TCGs is powered in part by Shopify, which enables us to provide the Services to you.

However, purchases made from House of TCGs are made directly with House of TCGs.

Shopify provides technology and infrastructure used to operate parts of our Services but is not the seller of the physical products you purchase from House of TCGs.

Certain information may be processed by Shopify in accordance with the applicable privacy policies.

SECTION 15 – PRIVACY

Personal information processed through the Services is handled in accordance with our Privacy Policy.

Our Privacy Policy applies to the House of TCGs:

  • Website

  • Online store

  • Mobile application

  • Customer accounts

  • HTG Loyalty functionality

  • Related Services

Certain information may also be processed by Shopify or other service providers in accordance with their own applicable privacy policies.

Please review our Privacy Policy for additional information concerning the collection, use, disclosure, retention and deletion of personal information.

SECTION 16 – REVIEWS AND FEEDBACK

You may be able to submit reviews, suggestions, feedback or other content through the Services.

You confirm that content you submit:

  • Does not knowingly contain false or misleading information

  • Does not unlawfully infringe third-party rights

  • Does not contain malicious software

  • Does not violate applicable law

You retain rights in content you own.

By submitting content intended for publication through House of TCGs, you grant us a non-exclusive right to use, reproduce and display that content as reasonably necessary to operate, improve and promote the Services, subject to applicable law.

We may moderate or remove content where reasonably necessary, including unlawful, fraudulent, abusive, misleading or infringing content.

SECTION 17 – ERRORS, INACCURACIES AND TECHNICAL ISSUES

Occasionally, information displayed through the Services may contain errors or inaccuracies concerning matters such as:

  • Product descriptions

  • Pricing

  • Promotions

  • Availability

  • Shipping charges

  • Release dates

  • Delivery estimates

We may correct such errors when discovered.

Where an obvious error materially affects an order, we may contact you to clarify the issue or, where legally permitted, cancel the affected transaction and refund amounts already paid.

We do not use this section to restrict mandatory consumer rights.

SECTION 18 – PROHIBITED USE

You may only use the Services for lawful purposes.

You must not use or attempt to use the Services to:

  • Commit fraud

  • Access another person's account without authorization

  • Circumvent security systems

  • Circumvent clearly communicated purchase limits

  • Manipulate HTG Loyalty or rewards

  • Abuse promotional codes

  • Introduce viruses or malicious software

  • Interfere with the operation of the Services

  • Obtain unauthorized access to systems or data

  • Harvest personal information unlawfully

  • Impersonate another person

  • Infringe intellectual property rights

  • Conduct unlawful scraping or automated activity that disrupts or abuses the Services

  • Violate applicable law

We may take reasonable and proportionate measures to prevent abuse and protect House of TCGs and its customers.

SECTION 19 – SUSPENSION AND TERMINATION

We may restrict, suspend or terminate access to all or part of the Services where reasonably necessary, including in cases involving:

  • Fraud

  • Security threats

  • Serious or repeated violations of these Terms

  • Manipulation of loyalty points or promotions

  • Unauthorized access

  • Legal requirements

  • Material disruption of the Services

Where appropriate and reasonably possible, we may provide notice before taking such action.

Suspension or termination of an account does not automatically remove or restrict statutory rights relating to orders already placed.

SECTION 20 – WARRANTIES AND STATUTORY RIGHTS

Nothing in these Terms excludes statutory warranties, statutory conformity requirements or mandatory consumer protection rights.

The availability of website or application functionality may occasionally be interrupted due to maintenance, updates, network failures, third-party infrastructure or other technical circumstances.

We do not guarantee that every optional digital feature will remain permanently available in exactly the same form.

This does not affect contractual obligations or mandatory statutory rights relating to products you purchase.

SECTION 21 – LIABILITY

House of TCGs is liable without limitation where liability cannot legally be limited, including for:

  • Intentional misconduct

  • Gross negligence

  • Injury to life, body or health

  • Mandatory product liability

  • Other liability that cannot legally be excluded or limited

In cases of ordinary negligence involving the breach of an essential contractual obligation, liability may be limited to foreseeable damage typical for this type of contract, where legally permitted.

An essential contractual obligation is an obligation whose performance is necessary for the proper execution of the contract and on whose performance the customer can regularly rely.

Any further limitation of liability applies only to the extent permitted by applicable law.

Mandatory consumer rights remain unaffected.

SECTION 22 – EVENTS OUTSIDE OUR REASONABLE CONTROL

We are not responsible for a failure or delay caused by circumstances outside our reasonable control to the extent permitted by law.

Such circumstances may include major carrier disruptions, natural disasters, government measures, widespread infrastructure failures or comparable events.

This does not remove statutory customer rights where applicable.

SECTION 23 – SEVERABILITY

If an individual provision of these Terms is found to be invalid or unenforceable, the remaining provisions remain effective to the extent permitted by law.

The applicable statutory rules apply in place of an invalid provision where necessary.

SECTION 24 – GOVERNING LAW

These Terms and contracts concluded through the Services are governed by the laws of the Federal Republic of Germany.

If you are a consumer whose habitual residence is in another country, this choice of law does not deprive you of mandatory consumer protections that apply under the law of your country of residence.

Any agreement concerning jurisdiction applies only to the extent legally permitted.

SECTION 25 – CHANGES TO THESE TERMS

We may update these Terms from time to time for legitimate reasons, including:

  • Changes to the Services

  • New application functionality

  • Security requirements

  • Operational changes

  • Legal or regulatory requirements

The current version will be made available through the House of TCGs website and, where applicable, the mobile application.

Changes do not retroactively alter already concluded purchase contracts unless legally permitted or expressly agreed.

Where legally required, customers will receive appropriate notice of material changes.
